Welcome to Pop Up. These Terms of Service ("Terms") govern your use of the Pop Up mobile app. By using Pop Up, you agree to these Terms. If you don't agree, please don't use the app. Questions? Email support@popupanalytics.app.
Pop Up helps you discover local pop-up markets and the vendors at them. Listings shown in the app — including markets, vendors, bios, and catalogs — may be provided by the businesses themselves. We don't guarantee the accuracy, availability, pricing, or quality of any market, vendor, or product you find through the app.
You can browse Pop Up without an account. If you create one, you're responsible for keeping your login secure and for activity under your account. You must provide accurate information and be at least 13 years old to create an account.
You can delete your account anytime from Settings → Delete account.
When using Pop Up, you agree not to:
Businesses may publish listings and content through Pop Up. That content belongs to whoever provided it, not to us. We don't endorse it and aren't responsible for it. If you believe content in the app is objectionable or infringes your rights, report it using the Report option in the app or email support@popupanalytics.app. We may remove content that violates these Terms.
When you buy something from a business you found through Pop Up, the purchase is directly between you and that business, outside the app and our control. We are not a party to those purchases and are not responsible for them.
Sellers who apply to an event may pay the event's booth fee in the app. Those payments are processed by Stripe. The Vendor Agreement a seller signs in the app sets out how booth fees, refunds and payouts work.
To sell on Pop Up, you connect your point of sale (for example, Square) and agree to the Pop Up Vendor Agreement in the app before the connection starts. Connecting is how you take part.
Once connected, Pop Up reads your items, prices, photos and sales through your point of sale. It never moves money or changes anything in your point of sale.
Your sales numbers belong to you. Pop Up shows them to you and, for each event you sell at, to that event's host. Pop Up may also count your sales, with your name and your business taken off, in market-wide statistics, such as typical prices or what sells at which kinds of events. Pop Up only shows a statistic when enough sellers are counted in it that no one business can be picked out, and never sells your individual numbers. If you do not want your sales read, do not connect a point of sale.
Pop Up is provided "as is" and "as available," without warranties of any kind to the fullest extent permitted by law. We don't guarantee the app will be uninterrupted, error-free, or that listings are accurate or up to date.
To the fullest extent permitted by law, Pop Up and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app.
We may change, suspend, or discontinue features at any time, and we may update these Terms. We'll update the "Last updated" date when we do. Continuing to use the app after changes means you accept the updated Terms.
